Terms of Service

These Terms of Service (“Terms”) govern your access to and use of DeepDataFusion’s websites, products, software, and services, including SuperConsolidator (collectively, the “Service”). By using the Service, you agree to these Terms. If you are entering into these Terms on behalf of a company, you represent that you have authority to bind that company. If you do not agree, do not use the Service.
1) Quick summary (not a substitute for the full Terms)
- Subscription renews automatically until you cancel. Trial is free for 7 days; cancel before day 7 to avoid charges.
- You own your Inputs & Outputs. We don’t use your data to train our foundation models. We store files privately in AWS S3 with server-side encryption.
- Use the Service lawfully and safely. Don’t upload illegal, infringing, or harmful content or try to break/abuse the Service.
- We provide the Service “as is” with standard disclaimers; our liability is limited to the fees you paid in the past 12 months.
2) Accounts, eligibility & organisation use
You must be at least 18. You are responsible for your account, credentials, and activity. If you create an account on behalf of an organisation, “Customer” means that organisation and “you” includes its authorised users.
3) Plans, trials, billing & taxes
- Free trial. New subscriptions include a 7-day free trial. No charges until the trial ends. If you do not want to continue, cancel before the end of day 7 via your account. After the trial, your paid plan begins automatically.
- Auto-renewal. Subscriptions renew automatically at the end of each billing cycle unless you cancel. You may cancel at any time; cancellation takes effect at the end of the current paid term.
- Fees & changes. Prices are shown exclusive of taxes and duties. We may change fees or features with at least 30 days’ notice for renewals. Promotional or beta pricing may change at renewal.
- Payment processing. Payments are handled by Stripe. We do not store card numbers on our servers. Apple Pay/Google Pay may be available through Stripe.
- Refunds. Except where required by law, fees are non-refundable and credits have no cash value. If required by law, we will issue refunds accordingly.
4) Acceptable use
You agree not to, and not to enable others to:
- Violate any law; infringe IP or privacy rights; upload unlawful, defamatory, deceptive, or harmful content.
- Distribute malware, attempt to gain unauthorised access, probe or overload the Service, or bypass security/usage limits.
- Use the Service for high-risk activities where failure could lead to death, personal injury, or environmental damage (e.g., medical diagnosis or life-critical control systems) without appropriate safeguards.
- Misrepresent output as created by a human without disclosure where required, or use outputs for automated decision-making about individuals without required notices/assessments.
5) AI-specific notices
- Outputs may be imperfect. The Service can generate or extract content programmatically and may produce errors (“hallucinations”), omissions, or misclassifications. You are responsible for human review and independent verification before relying on outputs.
- Regulatory use. If you use outputs in regulated contexts (e.g., finance, healthcare, employment), you must implement appropriate controls and comply with applicable laws.
6) Intellectual property; Inputs & Outputs
- Your content. “Inputs” means data you or your users submit (e.g., PDFs, images, text). “Outputs” means content generated by or extracted via the Service from your Inputs. As between you and us, you own your Inputs and Outputs.
- Service IP. We and our licensors retain all rights in the Service, software, models, templates, documentation, and branding.
- Limited licence to operate the Service. You grant us a worldwide, royalty-free licence to host, process, and transmit Inputs and Outputs solely to provide, maintain, secure, and support the Service (including abuse detection, debugging, quality/security monitoring, and usage analytics). We do not use your private content to train our foundation models.
- Feedback. If you provide suggestions, you grant us a perpetual, worldwide, irrevocable licence to use them without restriction.
7) Privacy & data protection
- Privacy Policy. Our Privacy Policy describes how we handle personal data.
- Processing location & security. Files are stored on AWS (ap-southeast-1) with server-side encryption; data in transit uses TLS 1.2+.
- DPA/SCCs. If you require a Data Processing Addendum (and, where applicable, EU/UK Standard Contractual Clauses), see /dpa. You may request a signed copy.
- Compliance. We process personal data in accordance with applicable law, including Malaysia’s PDPA 2010, GDPR (where applicable), and U.S. state privacy laws (e.g., CCPA/CPRA) to the extent they apply to your use and your data subjects.
8) Security
- Infrastructure. We use AWS S3 with server-side encryption at rest and TLS in transit. Access is limited by role and logged.
- Payments. Stripe is certified as a PCI DSS Level 1 Service Provider. You must keep your own systems secure and follow Stripe’s guidance.
- Incidents. We will notify you without undue delay of any confirmed data breach affecting your personal data, consistent with applicable law.
9) Usage limits & fair use
Plans may include limits (e.g., pages, tokens, storage, or API rate). We may throttle, temporarily suspend, or require an upgrade if usage materially exceeds plan limits or materially impacts Service stability or security.
10) Third-party services
The Service may interoperate with third-party services (e.g., Stripe, Google OAuth, AWS). Your use of third-party services is subject to their terms and privacy notices. We are not responsible for third-party services.
11) Beta & free features
We may offer beta, preview, or experimental features. They are provided “as is,” may change or end at any time, and may be subject to additional terms.
12) Suspension & termination
- We may suspend or terminate access immediately for breach of these Terms, unlawful conduct, risk to the Service or others, or non-payment.
- You may terminate at any time via your account settings; termination does not entitle you to a refund for the current term unless required by law.
- Upon termination, your licence to use the Service ends. We may delete or anonymise your content after a reasonable retention period, except where law requires longer retention.
13) Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability. We do not warrant that outputs will be correct, complete, or suitable for your use case.
14) Limitation of liability
To the maximum extent permitted by law, in no event will DeepDataFusion be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, or business interruption. Our total aggregate liability for all claims in the aggregate is limited to the amounts you paid to us for the Service in the 12 months immediately preceding the event giving rise to the claim.
15) Indemnity
You will defend, indemnify, and hold harmless DeepDataFusion from and against third-party claims and liabilities arising from your unlawful content, misuse of the Service, or breach of these Terms.
16) Sanctions & export control
You may not use the Service in violation of applicable export control or sanctions laws or for prohibited end uses.
17) Copyright complaints
If you believe content infringes your copyright, email support@deepdatafusion.com with details sufficient for us to identify the material and your ownership.
18) Changes to the Service or Terms
We may update these Terms from time to time. If we make material changes, we will notify you (e.g., by email or in-app notice) before they take effect. Your continued use after the effective date constitutes acceptance.
19) Governing law & venue
These Terms are governed by the laws of Malaysia, without regard to conflicts of laws. The courts of Kuala Lumpur, Malaysia have exclusive jurisdiction over disputes, and each party consents to personal jurisdiction and venue there.
20) Miscellaneous
- Assignment. You may not assign these Terms without our consent; we may assign to an affiliate or in connection with a merger, acquisition, or sale.
- Notices. We may provide notices by email to your account email or by posting in the Service. You may send legal notices to support@deepdatafusion.com.
- Severability. If any provision is unenforceable, the remainder remains in effect.
- Entire agreement. These Terms (plus any order form, Privacy Policy, and DPA) are the entire agreement regarding the Service and supersede prior agreements.
- No waiver. Failure to enforce a provision is not a waiver.
- Force majeure. Neither party is liable for delays due to events beyond reasonable control.
